ಸರ್ಕಾರದ ಸುಳ್ಳಿನ ಕಂತೆಗೆ ರಾಜ್ಯಪಾಲರು ಧ್ವನಿಯಾಗಬೇಕು ಎಂಬ ಕಡ್ಡಾಯ ನಿಯಮಸಂವಿಧಾನದಲ್ಲಿ ಇಲ್ಲ
ಪ್ರಗತಿವಾಹಿನಿ ಸುದ್ದಿ: ಅಭಿವೃದ್ಧಿ ಶೂನ್ಯ ಆಡಳಿತ, ಸಾಲು ಸಾಲು ಭ್ರಷ್ಟಾಚಾರ ಹಗರಣಗಳು ಹಾಗೂ ಆಡಳಿತಾತ್ಮಕ ವೈಫಲ್ಯವನ್ನು ಮರೆಮಾಚಲು ಸಿದ್ದರಾಮಯ್ಯ ನೇತೃತ್ವದ ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರವ ರಾಜ್ಯಪಾಲರ ಭಾಷಣವನ್ನು ರಾಜಕೀಯ ಅಸ್ತ್ರವಾಗಿ ದುರ್ಬಳಕೆ ಮಾಡಿಕೊಳ್ಳುತ್ತಿದೆ ಎಂದು ವಿಧಾನಸಭೆ ವಿರೋಧ ಪಕ್ಷದ ನಾಯಕ ಆರ್. ಅಶೋಕ್ ತೀವ್ರ ವಾಗ್ದಾಳಿ ನಡೆಸಿದ್ದಾರೆ.
ಬುಧವಾರ ಮಾಧ್ಯಮ ಹೇಳಿಕೆ ಬಿಡುಗಡೆ ಮಾಡಿದ ಅವರು, “ರಾಜ್ಯಪಾಲರು ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರದ ವಕ್ತಾರರಲ್ಲ; ಅವರು ಸಂವಿಧಾನದ ರಕ್ಷಕರು. ಅವರ ಘನತೆಗೆ ಧಕ್ಕೆ ತರುವ ಮೂಲಕ ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರ ಸಂವಿಧಾನ ಮತ್ತು ಫೆಡರಲ್ ವ್ಯವಸ್ಥೆಯ ಮೇಲೆ ನೇರ ದಾಳಿ ನಡೆಸುತ್ತಿದೆ” ಎಂದು ಹೇಳಿದರು.
ಸರ್ಕಾರದ ಪಠ್ಯಕ್ಕೆ ರಾಜ್ಯಪಾಲರು ಯಾಂತ್ರಿಕವಾಗಿ ಬದ್ಧರಾಗಬೇಕಿಲ್ಲ
“ಭಾರತದ ಸಂವಿಧಾನದ ವಿಧಿ 175 ಮತ್ತು 176ರ ಅಡಿಯಲ್ಲಿ ರಾಜ್ಯಪಾಲರಿಗೆ ವಿಧಾನಸಭೆ ಮತ್ತು ವಿಧಾನಪರಿಷತ್ತನ್ನು ಉದ್ದೇಶಿಸಿ ಭಾಷಣ ಮಾಡುವ ಸ್ಪಷ್ಟ ಅಧಿಕಾರವಿದೆ. ಆದರೆ ಸರ್ಕಾರ ತಯಾರಿಸಿದ ಪಠ್ಯದಲ್ಲಿರುವ ಪ್ರತಿಯೊಂದು ಪದವನ್ನೂ ರಾಜ್ಯಪಾಲರು ಕಡ್ಡಾಯವಾಗಿ ಓದಲೇಬೇಕು ಎಂಬ ನಿಯಮ ಸಂವಿಧಾನದಲ್ಲಿಯೂ ಇಲ್ಲ, ವಿಧಾನಸಭೆ ಅಥವಾ ವಿಧಾನಪರಿಷತ್ತಿನ ನಿಯಮಗಳಲ್ಲಿಯೂ ಇಲ್ಲ” ಎಂದು ಅಶೋಕ್ ಸ್ಪಷ್ಟಪಡಿಸಿದರು.
ಸಂವಿಧಾನದ ವಿಧಿ 163ರ ಪ್ರಕಾರ ರಾಜ್ಯಪಾಲರು ಸಾಮಾನ್ಯವಾಗಿ ಸಚಿವ ಸಂಪುಟದ ಸಲಹೆಯಂತೆ ಕಾರ್ಯನಿರ್ವಹಿಸಬೇಕಾದರೂ, ಅವರಿಗೆ ನಿರ್ದಿಷ್ಟ ವಿವೇಚನಾಧಿಕಾರವನ್ನೂ ಸಂವಿಧಾನವೇ ನೀಡಿದೆ. ಸರ್ಕಾರ ತಯಾರಿಸಿದ ಭಾಷಣದಲ್ಲಿ ಅಸಹ್ಯಕರ, ದ್ವೇಷಪೂರಿತ ಅಥವಾ ಸಂವಿಧಾನ ವಿರೋಧಿ ಅಂಶಗಳಿದ್ದರೆ, ಅವನ್ನು ಓದದೇ ಬಿಡುವುದು ರಾಜ್ಯಪಾಲರ ಸಂವಿಧಾನಾತ್ಮಕ ಹಕ್ಕು ಎಂದು ಅವರು ಹೇಳಿದರು.
“ಸರ್ಕಾರದ ಸುಳ್ಳಿನ ಕಂತೆಗೆ ರಾಜ್ಯಪಾಲರು ಧ್ವನಿಯಾಗಬೇಕು ಎಂಬ ಕಡ್ಡಾಯ ನಿಯಮವನ್ನು ಕಾಂಗ್ರೆಸ್ ತನ್ನದೇ ಸಂವಿಧಾನದಲ್ಲಿ ಬರೆದುಕೊಂಡಿದ್ದರೆ ಬೇರೆ ಮಾತು. ಆದರೆ ಭಾರತದ ಸಂವಿಧಾನದಲ್ಲಿ ಅಂತಹ ಯಾವುದೇ ವಿಧಿಯಿಲ್ಲ” ಎಂದು ಕಿಡಿಕಾರಿದರು.
ಒಕ್ಕೂಟ ವ್ಯವಸ್ಥೆಯನ್ನು ದುರ್ಬಲಗೊಳಿಸುವ ಕಾಂಗ್ರೆಸ್ ರಾಜಕೀಯ
ರಾಜ್ಯಪಾಲರು ಕೇಂದ್ರ ಮತ್ತು ರಾಜ್ಯಗಳ ನಡುವಿನ ಮಹತ್ವದ ಸಂವಿಧಾನಾತ್ಮಕ ಸೇತುವೆ ಎಂದು ಹೇಳಿದ ಅಶೋಕ್, ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರವು ಉದ್ದೇಶಪೂರ್ವಕವಾಗಿ ಆ ಸೇತುವೆಯನ್ನು ದುರ್ಬಲಗೊಳಿಸುವ ಕೆಲಸ ಮಾಡುತ್ತಿದೆ ಎಂದು ಆರೋಪಿಸಿದರು.
ನೀತಿ ಆಯೋಗದ ಸಭೆಗಳಿಗೆ ಗೈರು, ಜಿಎಸ್ಟಿ ಕೌನ್ಸಿಲ್ ಸಭೆಗಳಿಂದ ದೂರ ಉಳಿಯುವಿಕೆ, ಹಣಕಾಸು ಆಯೋಗದ ಮುಂದೆ ರಾಜ್ಯದ ಹಿತಾಸಕ್ತಿಯನ್ನು ಸಮರ್ಥವಾಗಿ ಮಂಡಿಸದಿರುವುದು, ಈ ಮೂಲಕ ರಾಜ್ಯಕ್ಕೆ ಬರಬೇಕಾದ ಅನುದಾನವನ್ನು ತಾವೇ ತಡೆದು, ನಂತರ ಕೇಂದ್ರದ ಮೇಲೆ ಆರೋಪ ಮಾಡುವುದೇ ಕಾಂಗ್ರೆಸ್ನ ರಾಜಕೀಯ ತಂತ್ರ ಎಂದು ಹೇಳಿದರು.
ಎಟಿಎಂ ಸರ್ಕಾರಕ್ಕೆ ಅಭಿವೃದ್ಧಿಗಿಂತ ರಾಜಕೀಯವೇ ಮುಖ್ಯ
ಸಿದ್ದರಾಮಯ್ಯ ಸರ್ಕಾರ ಅಧಿಕಾರಕ್ಕೆ ಬಂದ ದಿನದಿಂದಲೂ ಆಡಳಿತಕ್ಕಿಂತ ರಾಜಕೀಯ ಸಂಘರ್ಷವನ್ನೇ ಸಾಧನೆಯೆಂದು ಬಿಂಬಿಸುತ್ತಿದೆ ಎಂದು ಅಶೋಕ್ ಆರೋಪಿಸಿದರು.
ಅಭಿವೃದ್ಧಿ ಕುಂಠಿತ:ರಾಜ್ಯದಲ್ಲಿ ಅಭಿವೃದ್ಧಿ ಕಾಮಗಾರಿಗಳು ಸ್ಥಗಿತಗೊಂಡಿವೆ. ಗುತ್ತಿಗೆದಾರರಿಗೆ ಪಾವತಿ ಮಾಡಲು ಸರ್ಕಾರದ ಬಳಿ ಹಣವಿಲ್ಲ.
ಭ್ರಷ್ಟಾಚಾರದ ಸರಮಾಲೆ: ಮುಡಾ ಹಗರಣ, ವಾಲ್ಮೀಕಿ ನಿಗಮದ ಹಣ ವರ್ಗಾವಣೆ, 40% ಕಮಿಷನ್ ಆರೋಪಗಳು ಸರ್ಕಾರವನ್ನು ಜನರ ಮುಂದೆ ನಗ್ನಗೊಳಿಸಿವೆ.
ಗಮನ ಬೇರೆಡೆ ಸೆಳೆಯುವ ಯತ್ನ: ಈ ಹಗರಣಗಳಿಂದ ಜನರ ಗಮನ ತಪ್ಪಿಸಲು ರಾಜ್ಯಪಾಲರ ಭಾಷಣವನ್ನು ವಿವಾದಕ್ಕೆ ಎಳೆದು ತರುತ್ತಿದ್ದಾರೆ.
ಸುಳ್ಳು ಹೇಳುವುದು ಸರ್ಕಾರದ ಮ್ಯಾಂಡೇಟ್ ಅಲ್ಲ
“ಚುನಾಯಿತ ಸರ್ಕಾರಕ್ಕೆ ಜನರ ಸೇವೆ ಮಾಡುವ ಮ್ಯಾಂಡೇಟ್ ಇದೆಯೇ ಹೊರತು, ರಾಜ್ಯಪಾಲರ ಬಾಯಲ್ಲಿ ಸುಳ್ಳು ಹೇಳಿಸುವ ಅಧಿಕಾರವಿಲ್ಲ” ಎಂದು ಅಶೋಕ್ ಕಿಡಿಕಾರಿದರು.
ಎನ್ಇಪಿ ರದ್ಧತಿ, ತೆರಿಗೆ ಹಂಚಿಕೆ, ಅನುದಾನ ವಿಚಾರಗಳಲ್ಲಿ ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರ ರಾಜ್ಯಪಾಲರ ಭಾಷಣದ ಪಠ್ಯದಲ್ಲಿ ಹಸಿ ಸುಳ್ಳುಗಳನ್ನು ಸೇರಿಸಿದೆ. ಸುಳ್ಳು ಹೇಳದಿರುವುದು ರಾಜ್ಯಪಾಲರ ಪರಮಾಧಿಕಾರ. ಅದನ್ನು ಅವರು ಬಳಸಿದಾಗ ಕಾಂಗ್ರೆಸ್ ನಾಯಕರು ಆಕ್ರೋಶ ವ್ಯಕ್ತಪಡಿಸುವುದು ಅವರ ರಾಜಕೀಯ ಹತಾಶೆಯನ್ನು ತೋರಿಸುತ್ತದೆ ಎಂದು ಹೇಳಿದರು.
ರಾಜ್ಯಪಾಲರ ಘನತೆಗೆ ಧಕ್ಕೆ – ಸಂವಿಧಾನಕ್ಕೆ ಅವಮಾನ
“ಈ ಸರ್ಕಾರ ಇಂದು ದಿವಾಳಿಯ ಅಂಚಿನಲ್ಲಿ ನಿಂತಿದೆ. ಜನರ ಮುಂದೆ ಹೋಗಲು ಮುಖವಿಲ್ಲದೆ, ರಾಜ್ಯಪಾಲರ ಉನ್ನತ ಹಾಗೂ ಗೌರವಾನ್ವಿತ ಹುದ್ದೆಯನ್ನು ರಾಜಕೀಯ ಜಿದ್ದಾಜಿದ್ದಿಗೆ ಎಳೆದು ತರುತ್ತಿರುವುದು ಸಂವಿಧಾನಕ್ಕೆ ಮಾಡುತ್ತಿರುವ ಅವಮಾನ” ಎಂದು ಆರ್. ಅಶೋಕ್ ಎಚ್ಚರಿಸಿದರು.
ರಾಜ್ಯಪಾಲರು ತಮ್ಮ ವಿವೇಚನಾಧಿಕಾರವನ್ನು ಬಳಸಿರುವುದು ಸಂಪೂರ್ಣವಾಗಿ ಸಂವಿಧಾನಸಮ್ಮತ. ಇದನ್ನು ಪ್ರಶ್ನಿಸುವ ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರ ಮೊದಲು ಸಂವಿಧಾನ ಓದಲಿ, ಅರ್ಥಮಾಡಿಕೊಳ್ಳಲಿ ಎಂದು ಅವರು ತೀವ್ರವಾಗಿ ಹೇಳಿದರು.
Governors Are Not Spokespersons of the Congress Government; They Are Protectors of the Constitution: Opposition Leader R. Ashok
To cover up its zero-development administration, a series of corruption scandals, and administrative failures, the Siddaramaiah-led Congress government is misusing the Governor’s speech as a political weapon, alleged Legislative Assembly Opposition Leader R. Ashok in a sharp attack.
In a press statement released on Wednesday, he said, “Governors are not spokespersons of the Congress government; they are protectors of the Constitution. By undermining their dignity, the Congress government is directly attacking the Constitution and the federal system.”
Governors Are Not Mechanically Bound to the Government’s Script
“Under Articles 175 and 176 of the Indian Constitution, Governors have clear authority to address the Legislative Assembly and Legislative Council. However, there is no rule in the Constitution, nor in the rules of the Legislative Assembly or Legislative Council, that Governors must compulsorily read every single word in the script prepared by the government,” Ashok clarified.
According to Article 163 of the Constitution, while Governors generally act on the advice of the Council of Ministers, the Constitution itself grants them specific discretionary powers. If the government’s prepared speech contains objectionable, hateful, or anti-constitutional elements, it is the Governor’s constitutional right to omit reading them, he stated.
“If the Congress has written a mandatory rule in its own constitution that Governors must voice the government’s bundle of lies, that’s a different matter. But there is no such provision in the Indian Constitution,” he lashed out.
Congress Politics Weakening the Federal System
Describing Governors as an important constitutional bridge between the Center and the states, Ashok accused the Congress government of deliberately working to weaken that bridge.
Boycotting NITI Aayog meetings, staying away from GST Council meetings, failing to effectively present the state’s interests before the Finance Commission—through these actions, the government is blocking the funds due to the state and then blaming the Center; this is the Congress’s political strategy, he said.
For the ATM Government, Politics Is More Important Than Development
Ashok alleged that since coming to power, the Siddaramaiah government has been projecting political conflicts as achievements rather than focusing on administration.
Development Stalled: Development works in the state have come to a halt. The government lacks funds to pay contractors.
Chain of Corruption: The MUDA scam, Valmiki Corporation fund transfer, and 40% commission allegations have exposed the government before the people.
Attempt to Divert Attention: To divert public attention from these scandals, they are dragging the Governor’s speech into controversy.
Lying Is Not the Government’s Mandate
“An elected government has a mandate to serve the people, not the authority to force lies into the Governor’s mouth,” Ashok fumed.
In matters like NEP cancellation, tax devolution, and grants, the Congress government has included blatant lies in the Governor’s speech script. Refusing to utter lies is the Governor’s paramount right. When they exercise it, the outrage from Congress leaders reveals their political desperation, he said.
Undermining Governor’s Dignity – Insult to the Constitution
“This government stands on the brink of bankruptcy today. Without the face to go before the people, dragging the Governor’s high and honorable position into political tussles is an insult to the Constitution,” R. Ashok warned.
The Governor’s use of discretionary powers is completely constitutional. The Congress government questioning this should first read and understand the Constitution, he said sharply.
